Loan Officer Overtime Claims Under Investigation

To be ineligible to collect overtime, a loan officer, or any other employee, must be found ‘exempt’ from overtime law. This means that the employee must meet a strict set of criteria which disqualifies them from overtime pay. For instance, employees who are “exempt” executives must be paid on a salary basis and receive at least $455 per week; manage the company, a department or subdivision; regularly direct the work of two or more full-time employees; and have the authority or influence to hire or fire other employees. Likewise, “exempt” administrators must earn a salary of at least $455 per week; perform office or non-manual work directly related to business operations; and exercise discretion and independent judgment in significant matters.
