Overtime Claims from JP Morgan Business Bankers Under Investigation

Business bankers, even those paid on a salary basis, are entitled to overtime pay, unless they fall under one of the five major overtime exemptions. Employees who meet an exemption under overtime law are not entitled to collect overtime pay. However, to be truly ineligible for overtime pay under these exemptions, the employee must meet a strict set of criteria. For instance, an employee who is exempt from overtime pay under the administrative exemption must earn a salary of at least $455 per week; exercise discretion and independent judgment in significant matters; and perform office or non-manual work directly related to management or the general business operations of the employer or their customers.
