A federal judge in Denver has denied a request by Joseph Nacchio, the former chief executive of Qwest Communications, for a new trial on insider trading charges.
Prosecutors said he sold $52 million worth of stock in 2001 while knowing that Denver-based Qwest risked missing its publicly-stated sales targets, The Associated Press reported. Mr. Nacchio was sentenced in 2007 to six years in prison and was ordered to pay $71 million, but he has appealed the sentence.
Mr. Nacchio argued he deserved a new trial because testimony from a former Qwest chief financial officer, Robin Szeliga, in a more recent deposition in a related civil case differed from testimony she gave at Mr. NacchioÂ’s trial, The Associated Press said.
U.S. District Judge Marcia Krieger ruled Tuesday that the testimony wasnÂ’t substantially different and probably wouldnÂ’t lead to an acquittal.
Ms. Szeliga testified at trial that she warned Mr. Nacchio that Qwest might miss a 2001 revenue target by almost $1 billion, but there was ambiguity over whether the warning referred to QwestÂ’s publicly stated sales target or a higher internal goal, Judge Krieger wrote.
Mr. NacchioÂ’s lawyers argued that Ms. SzeligaÂ’s warning referred to the higher target, and that the projected shortfall was small enough that it didnÂ’t have to be publicly disclosed.
Judge Krieger ruled Tuesday that, over all, Ms. SzeligaÂ’s newer deposition testimony was as ambiguous as her trial testimony, both of which were given years later. The judge said Ms. Szeliga testified at the deposition that her memory of the events was fading and that Ms. Szeliga did not recant her trial testimony during the deposition.
