(EstateNewsWire.com, October 22, 2012 ) San Francisco, CA -- An Army veteran and his wife claim a Minnesota-based firm and debt collection agency illegally garnished savings to cover a defaulted student loan. They also claim the collectors verbally abused them when they asked for their money back.
Michael Collier was declared 100% disabled after suffering spinal and head injuries during time spent in the Army. His earned disabilities entitled him to Social Security payments that were considered exempt from debt garnishment.
That fact failed to deter Custrel Chargo from seizing funds from the account of Michael’s wife, Kim Collier, to pay $6,000 of defaulted student loans.
In May, a judge ordered Kim’s credit union to unfreeze her assets effective immediately following declaring the account was, in fact, exempt from garnishment. Gustrel attorney allegedly told Collier that he would need to sue the collection agency to “get his money back.”
Collier attempted to explain the matter over the phone to Gustrel. What he was met with was defined as a barrage of obscenities and insults from a paralegal, who has not been identified.
“The assistant told Michael, ‘Fuck you! Pay us your money! You can’t afford an attorney. You owe us. I hope your wife divorces your ass. If you would have served our country better, you would not be a disabled veteran living off social security while the rest of us honest Americans work our ass off. Too bad; you should have died.”
A subsequent lawsuit has been filed by the Colliers, who demand a variety of damages for Gustrel violating the Fair Debt Collection Practices act. The action prohibits harassment or abuse from collectors or associates in any form.
